OVERVIEW

Welcome to Plant.ess. The terms “we”, “us” and “our” refer to Plant.ess. We operate this website and online store, including all related information, content, features, tools, products and services (the “Services”) to provide you with a curated shopping experience. Plant.ess is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with any policies referenced herein, describe your rights and responsibilities when you use the Services.

Please read these Terms carefully. By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use or access the Services.

SECTION 1 – ACCESS AND ACCOUNT

By using the Services, you confirm that you are at least the age of majority in your jurisdiction, or that you have permission from a parent or legal guardian.

To use certain parts of the Services or complete a purchase, you may be required to provide information such as your email address, billing address, payment details, and shipping information. You confirm that the information you provide is accurate, current, complete, and that you have the right to provide it.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to anyone else.

SECTION 2 – OUR PRODUCTS

We make every effort to display product information as accurately as possible. However, colors and appearance may vary depending on device settings and screen displays.

Product descriptions and availability may be updated or changed at any time. We reserve the right to discontinue products, limit quantities, or restrict sales to certain regions or customers at our discretion.

SECTION 3 – ORDERS

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order at our discretion.

An order is not accepted until we confirm it and payment has been processed. Please review your order carefully before submitting it, as we may not be able to accommodate cancellations after acceptance.

If we do not accept, modify, or cancel an order, we will attempt to notify you using the contact details provided at checkout.

Returns and refunds are handled strictly according to our Returns & Refunds Policy.

Purchases are for personal use only and not for commercial resale unless we have agreed otherwise in writing.

Customers are responsible for ensuring delivery access and prompt pickup, including during holidays.

SECTION 4 – PRICES AND BILLING

Prices and promotions may change without notice. The price charged will be the price shown at the time your order is placed and confirmed.

Unless otherwise stated, prices do not include shipping fees or any applicable customs/import charges for destinations outside the EU. You agree to provide accurate billing and payment information and to keep it updated.

SECTION 5 – SHIPPING & DELIVERY

General Shipping

All delivery times provided are estimates only and are not guaranteed. We are not responsible for shipping delays caused by carriers, customs processing, weather conditions, public holidays, or other circumstances outside our control.

Shipping costs, methods, and estimated delivery times are displayed at checkout.

Once an order has been handed over to the carrier, delivery is outside of our direct control. Customers are responsible for ensuring that the provided shipping address is correct and that the shipment can be received and collected promptly upon delivery.

Live Plants & Perishable Goods

Orders containing live plants, corms, tissue culture, or other perishable goods are shipped weather permitting.

If temperatures or conditions are deemed unsafe for plant transport, we reserve the right to delay shipment until conditions improve. This is done to protect the health and quality of the plants. Shipping delays due to weather conditions do not qualify for cancellations or refunds.

By placing an order containing live plants, you acknowledge and accept the inherent risks associated with shipping living material.

Heat Packs & Seasonal Protection

During colder periods, heat packs may be added at our discretion or offered as an optional add-on. Heat packs reduce risk but do not guarantee plant survival during transit.

We are not responsible for damage caused by extreme temperatures once the shipment has been handed over to the carrier.

Delivery Responsibility

Customers are responsible for:

Monitoring tracking information
Being available to receive the delivery
Promptly collecting parcels from pickup points

We are not responsible for damage, loss, or plant decline caused by delayed collection, failed delivery attempts, or incorrect address information provided by the customer.

Dead on Arrival (DOA)

If a live plant arrives dead on arrival (DOA), you must contact us within 6 hours of delivery and provide a clear unpacking video of:

the plant
the packaging
the shipping label

Claims submitted outside this timeframe will not be accepted.

Approved DOA cases are handled in accordance with our Returns & Refunds Policy.

Transfer of Risk

Risk associated with shipping transfers to the customer once the order has been handed over to the carrier, to the extent permitted by applicable consumer protection laws.

Nothing in this section limits or excludes mandatory consumer rights under applicable law.

SECTION 6 – INTELLECTUAL PROPERTY

All content on the Services, including text, graphics, images, product photos, videos, logos, designs, and the arrangement of content, is owned by Plant.ess or our licensors and is protected by applicable intellectual property laws.

You may use the Services for personal, non-commercial use only. You may not reproduce, distribute, modify, or exploit any content from the Services without our prior written permission.

SECTION 7 – OPTIONAL TOOLS

We may provide access to third-party tools or services that we do not monitor or control. These tools are provided “as is” and “as available” without warranties or endorsements. Use of any optional third-party tools is at your own risk.

SECTION 8 – THIRD-PARTY LINKS

The Services may include links to third-party websites or platforms. We are not responsible for the content, privacy practices, or accuracy of third-party sites. Accessing them is at your own risk.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Plant.ess is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Plant.ess. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Plant.ess, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Plant.ess.

SECTION 10 – PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy. By using the Services, you acknowledge that you have read our Privacy Policy and understand how we collect and process personal information.

Because the Services are hosted by Shopify, Shopify may also collect and process certain personal information to provide and improve the platform.

SECTION 11 – FEEDBACK

If you submit feedback, reviews, suggestions, or other content (“Feedback”), you grant us a worldwide, royalty-free license to use, reproduce, modify, publish, distribute, and display that Feedback for business purposes, including marketing and improving the Services.

You confirm that you have the rights to submit the Feedback and that it does not violate any third-party rights or applicable laws.

SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS

We may occasionally have errors or inaccuracies relating to product descriptions, pricing, promotions, shipping, or availability. We reserve the right to correct errors and to cancel or refuse orders if information is inaccurate, even after an order has been submitted.

SECTION 13 – PROHIBITED USES

You may use the Services only for lawful purposes. You agree not to misuse the Services, including by attempting to gain unauthorized access, transmitting malicious code, scraping, spamming, impersonation, or violating the rights of others.

We reserve the right to suspend or terminate access to the Services if we believe you have violated these Terms.

SECTION 14 – TERMINATION

We may terminate or restrict your access to the Services at any time if we believe you have violated these Terms. You remain responsible for all amounts due up to the date of termination.

Sections that by their nature should survive termination will remain in effect.

SECTION 15 – DISCLAIMER OF WARRANTIES

The Services and products are provided “as is” and “as available” to the extent permitted by applicable law. We do not guarantee that the Services will be uninterrupted, secure, or error-free.

Nothing in these Terms limits rights that cannot be excluded under applicable consumer laws.

SECTION 16 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, Plant.ess and its partners, employees, service providers, and affiliates will not be liable for indirect, incidental, punitive, special, or consequential damages arising from your use of the Services or products purchased through the Services.

Nothing in these Terms limits liability where such limitation is not permitted under applicable law.

SECTION 17 – INDEMNIFICATION

You agree to indemnify and hold harmless Plant.ess and Shopify, and our respective affiliates, employees, and service providers, from claims arising out of your breach of these Terms or your misuse of the Services.

SECTION 18 – SEVERABILITY

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will remain in full force and effect.

SECTION 19 – WAIVER; ENTIRE AGREEMENT

Failure to enforce any provision is not a waiver. These Terms and referenced policies constitute the entire agreement between you and Plant.ess relating to the Services.

SECTION 20 – ASSIGNMENT

You may not transfer your rights under these Terms without our written consent. We may assign these Terms as part of our business operations as permitted by law.

SECTION 21 – GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to conflict of law principles. Any disputes shall be handled by the competent courts in Sweden, unless mandatory consumer protection laws in your country of residence provide otherwise.

SECTION 22 – HEADINGS

Headings are included for convenience only and do not affect interpretation.

SECTION 23 – CHANGES TO TERMS

We may update these Terms from time to time. The most current version will always be available on this page. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms, to the extent permitted by applicable law.
